City tackles busy agenda

NILES - The Niles City Council held their regularly scheduled meeting Monday night, with an update on the Majerek building along with several items lining their agenda - including an approval that could kick off some enthusiasm for the annual Hunter Ice Festival.

City Administrator Terry Eull said Tuesday morning that Mayor Mike McCauslin made the announcement that the Majerek building as well as the South Bend Tribune office and second floor apartment that had been located next door would be demolished and the space cleared out as soon as Nov. 10. A fire in June had essentially destroyed both structures.

A request by the Main Street Downtown Development Authority was approved to install a banner over Main Street for the Hunter Ice Festival until Jan. 19. Permission for the request had already been granted by permit through the Michigan Department of Transportation.

Also on the agenda, the council approved a request from the Niles-Buchanan YMCA to hold the 27th Annual Thanksgiving Day Run on Thursday, Nov. 27 beginning at 8:45 a.m. and ending at about 10:45 a.m.

Support the Fort, Inc. also had a request accepted, to hold the annual Fort St. Joseph Living History Fair and Education Days. The event was requested to begin Oct. 24 through Oct. 27 taking place in Riverfront Park by the French Paper Dam.

A high bid of $1,851.00 for the sale of a 1960 Huber-Warco grader to NCP Coatings, Inc. of Niles, was approved.

The council also considered a proposal of $3,514.50 from Kenmark, Inc. of Buckley, Mich. to repaint runway 4/22 at Jerry Tyler Memorial Airport. That proposal was accepted.

Finally, as part of the consent agenda Monday night, Niles city council members also accepted a recommendation from the Utilities Department to contract with Solomon Corporation of Solomon, Kans. for a two-year period for the disposal of PCB contaminated waste.

An item previously tabled by the council was brought back to the council also, Monday night. Approval was given for the use of 2007 Federal Transit Administration grant funds to purchase a new AC recovery and recharge machine, tire changer and new tire balancer for use at the Dial-A-Ride garage at a total cost of $8,791.53.

And approval was given for a request to provide an annual $20,000 contribution to the Southwestern Michigan Economic Growth Alliance, Inc. for the continuation of membership services that include economic development for the retention and creation of jobs.

In the City Attorney's report a second reading and enactment was held of an ordinance to adopt the 2006 edition of the International Fire Code. The code's purpose being to regulate and govern the safeguarding of life and property from fire and explosion hazards arising from storage, handling, and use of hazardous substances, materials and devices as well as from conditions hazardous to life or property in the occupancy of buildings and premises in the City of Niles. The code also includes providing for the issuance of permits for hazardous uses or operations, repealing Ordinance No. 433 of the City of Niles and all other ordinances and parts of the ordinances in conflict.

And a second reading and enactment was held of an ordinance to adopt by reference the 2006 International Property Maintenance Code, with certain insertions, amendments, additions and deletions as the Property Maintenance Code of the City of Niles. Adoption would be to establish minimum standards for the maintenance and conditions of all properties, buildings and structures; to prescribe standards for supplied utilities, facilities and equipment. The code goes on to include the conditions essential for safe, sanitary and fit occupancy and use; to provide for the enforcement of the provisions contained herein and for penalties and other remedies for violations hereof; and to repeal ordinance No. 436.
